Do Kwon, the founder of Terra (LUNA), temporarily escaped extradition to the United States after rejecting a decision by an appeals court in Montenegro. The High Court approved the extradition last month, but the Court of Appeal ruled it was tainted by a “serious breach of the provisions of the Criminal Code” and sent the case back to a lower court for a new trial.

Terra (LUNA) founder Do Kwon is temporarily out of trouble : While Montenegro’s High Court approved Do Kwon’s extradition last month, the country’s appeals court rejected the decision and responded favorably to an appeal filed by Do Kwon’s lawyers.
According to the official statement, the matter is as follows returned to the Court of First Instance of Montenegro for a new trial.

The November 17 Supreme Court ruling confirmed that “ The legal conditions for the extradition of South Korean citizen, accused Kwon Do Hyeong, for multiple crimes and at the request of the Republic of South Korea and the United States have been met. “.
But the Court of Appeal decided otherwise :
“When deciding on the appeal of the defense attorney of the accused, the panel of the Court of Appeal took this into account this decision was influenced by a substantial violation of the provisions of the Criminal Code § 386 paragraph 1. § 9 tr. ř., the violation of which is reasonably indicated by the appeal of the defendant’s defense attorneys, because the decision is not justified by decisive facts and the stated reasons are not obvious, which is a reason for its cancellation. »
The appeals court clarifies that the request to extradite Do Kwon to the United States cannot proceed under the current state of affairs to the extent that the person concerned was not heard by the investigating judge for his defense. On the other hand, he had previously agreed to be extradited to South Korea, where he is from.
The Wall Street Journal revealed earlier this month that Do Kwon was likely to be extradited to the United States, according to people close to Montenegrin Justice Minister Andrej Milović. However, it remains to be seen whether the Supreme Court of Montenegro or Do Kwon’s lawyers will be right.. Regardless, Do Kwon will face trial on the various charges he faces in both jurisdictions.
In particular, he will have to clarify his responsibilities regarding the collapse of the Terra ecosystem, which caused an overall decline in the cryptocurrency market, but above all, it caused $40 billion to disappear in record time.
